Vibe Pilates Terms of Service

Effective Date: October 2026

This Terms of Service (the “Agreement”) is between You, the user and client, and Teletek, LLC d/b/a Vibe Pilates (“Vibe”).

Vibe Policies

Classes must be cancelled at least 12 hours prior to the start of class. If You do not cancel or reschedule before the cancellation window closes, You will be considered a late cancel, lose your class credit, and incur a fee. Each client is granted one grace period lifeline per membership year.

There is a 5-minute grace period for late arrivals, unless a client is on the waitlist or waiting standby, at which point your spot will be given away if we have not heard from you via phone or text to the studio at 715-832-5050.

Grip socks are NOT mandatory but available for purchase at the studio. You may go barefoot or wear grip socks — regular socks are not allowed.

Instructors are subject to change and classes are subject to cancellation without notice. When possible, an email will be sent communicating any changes to the schedule. Subject to any opt-out, You consent to receive notice from Vibe pertaining to any class or session which You are registered for. Vibe is not responsible if You do not read the notices.

You may freeze your membership once per year for a minimum of one month. All freeze requests must be made at least 7 business days prior to the requested freeze date.

There is no childcare available in the building.

Safety is our priority. Our instructors are trained to provide hands-on cueing and corrective touches during classes to ensure that all clients are safe and maintaining correct form.

I. Purchasing Information

1.1 Purchasing & Payments

All classes are reserved and paid for in advance through Vibe’s online booking system, powered by MarianaTek. All sales are final, and classes and sessions are not eligible for transfer, exchange, or refund, except as required by law, including Section 2.5. Packages cannot be shared between clients. All fees and charges — including any applicable taxes and late fees — will be charged to a valid and up-to-date debit or credit card on file. As some services require auto-billing for continued monthly access, You agree to maintain valid credit card information as part of your Account information when applicable.

1.2 Package Expiration

Class packages refer to any purchase of a pre-determined allotment of classes to be redeemed at Vibe within a given time frame. Unless otherwise specified as a Monthly Recurring Membership, packages are not subject to auto-renewal. All session credits and packages expire as described on the Website from the date of purchase, unless noted otherwise at the time of purchase. There are no extensions, refunds, or freezes for purchases or expired sessions, except as required by law, including Section 2.5. You are responsible for noting your package expiration date. Vibe will not send reminders or follow-up. Remaining credits at the time of package expiration will be forfeited and will not roll over or be converted into Vibe credit.

1.3 Package Policies

By purchasing a package of classes with Vibe You agree that: (1) Packages are not shared or transferable between individuals unless expressly agreed upon by Vibe ownership in writing; (2) expiring packages may not be extended, transferred, refunded, shared, or frozen, except as required by law, including Section 2.5; (3) Vibe will not adjust or extend packages due to accidental bookings or the acts or omissions of clients — the expiration date set on an expiring package is the date on which the sessions in the package may no longer be used; and (4) clients purchasing packages do so with the express understanding of these terms and agree to be bound by them.

1.4 First Time Clients

Each individual may take advantage of the Vibe Intro Offer — 5 Classes for $99 — once. The offer must be redeemed within the specified offer window. Individuals may not create multiple accounts to take advantage of the offer numerous times. Those found in violation will immediately lose access to the purchase with no refund, except as required by law, including Section 2.5, and may be prevented from attending classes at the studio in the future.

1.5 Founding Membership Billing

For clients who purchased a Founding Membership during the presale period, the first payment is collected on the purchase date to secure the founding rate. The second payment will be billed 30 days after the date of the client’s first attended class.

1.6 Refund Policy

It is Vibe’s intention for You to be happy with your experience and participation in our services. Due to the extensive time, effort, preparation, and care that goes into creating and providing our services, all sales are final and no refunds will be provided, except as required by law, including Section 2.5.

1.7 Payment Processor

Payments made on the Sites are processed by the third-party payment processor MarianaTek, integrated by the Website host. You are required to store a valid and up-to-date debit or credit card on file within your Account for: (1) incidental charges such as late cancel fees; (2) ease of transaction; (3) enrollment in a Membership, which does require a credit card on file; and/or (4) recurring payments for services on a payment plan. In the event that an incidental charge needs to be made, the cardholder and account holder gives permission to Vibe to charge the card on file.

1.8 Account

Upon your first purchase of services, or first use of the Sites and/or Website, You will be prompted to create an account (the “Account”) with Vibe via third-party hosting platform MarianaTek. Your Account is password protected and is where You will purchase and book services, access certain purchased products, and securely store credit card information.

II. Membership

2.1 Memberships

Vibe offers various Memberships, which refer to a renewing monthly commitment to a certain number of classes or unlimited access. Memberships are billed monthly and automatically renew monthly on the same date of the original Membership purchase. Membership will continue to renew each month until cancelled by You. Failure to timely cancel will result in auto-renewal.

Please visit the Website or contact the studio for current pricing.

2.2 Auto Debit

By purchasing a Membership, You expressly agree that Vibe is authorized to, on a recurring basis on the same day of each month, automatically charge the debit or credit card You specified in your Account for the auto-debit plan You enrolled in. You understand and acknowledge that: (1) Vibe will initiate transfers and charges pursuant to this authorization not to exceed the amount shown on the billing invoice and/or in connection with cancellation fees per the cancellation policy — Vibe may discontinue processing of recurring charges if it is unable to secure funds due to insufficient funds or inaccurate information; (2) it is your responsibility to keep a current card on file with accurate billing information — Vibe cannot be held responsible for errors in processing due to expired or inaccurate information; and (3) Vibe is not responsible for any bank overdraft fees that may occur.

2.3 Membership Cancellation

Membership will continue to renew each month unless a cancellation is requested at least 30 days in advance of the auto-renewal date. Cancellation requests must be submitted in writing via email to hello@vibe-pilates.com. When You cancel, You maintain access to the Membership through the end of your billing cycle.

2.4 Membership Freeze/Pause

You may freeze your membership once per year for a minimum of one month. All freeze requests must be made in writing via email at least 7 business days prior to the requested freeze date. Emails shall be directed to hello@vibe-pilates.com and must include: (1) the date the membership is to be frozen; and (2) the date to unfreeze the membership, so long as it is at least one month from the freeze date. You understand that your Membership will automatically be unfrozen and You will be charged on the date provided. If You request to extend the length of your freeze, it is within Vibe’s sole discretion to allow for the extension.

2.5 Wisconsin Fitness Center Disclosures

Wisconsin Statute 100.177

CANCELLATION AND REFUNDS

Right to Cancel. You are permitted to cancel this contract until midnight of the 3rd operating day after the date on which you signed the contract. If the facilities or services described in the contract are not available at the time you sign the contract, you have until midnight of the 3rd operating day after the day on which you received notice of their availability to cancel the contract. If within this time period you decide you want to cancel this contract, you may do so by notifying Vibe Pilates by any writing mailed or delivered to Vibe Pilates at 2839 Mall Drive, Eau Claire, WI 54701, or via email at hello@vibe-pilates.com, within the previously described time period. If you do so cancel, any payments made by you, less a user fee of no more than $3 per day of actual use, will be refunded within 21 days after notice of cancellation is delivered, and any evidence of any indebtedness executed by you will be canceled by Vibe Pilates and arrangements will be made to relieve you of any further obligation to pay the same.

Death or Disability. If the buyer is unable to make use of or receive Vibe services because of death or disability, the buyer is liable for only that portion of the total consideration proportional to the elapsed time portion of the contract at the time of the death or disability. [Wisconsin Statute 100.177(12)]

Facility Unavailability. If any of the facilities or services described in this contract become unavailable or are no longer fully operational before full receipt of the services and use of facilities for which the buyer contracted, the buyer is liable for only that portion of the total consideration proportional to the elapsed time portion of the contract at the time of the unavailability. The buyer is entitled to a refund of any other funds already paid. The buyer also has the option, in lieu of a proportional refund, to complete the unused portion of the contract at another location owned, controlled, affiliated with, or operated by Vibe Pilates. [Wisconsin Statute 100.177(11)]

Copy of Contract. Vibe will provide You with a copy of this Agreement and your membership contract at the time You sign, by email or in print. [Wisconsin Statute 100.177(2)]

III. Reservations & Cancellation Policies

3.1 Cancellations, Rescheduling & Late Cancel Policy

Classes must be cancelled at least 12 hours prior to the start of class. Cancellations and reschedules may be done online only via: (1) your Account; or (2) the confirmation email sent at the time of booking. There are no refunds on cancelled classes, except as required by law, including Section 2.5 — your Account will be credited back.

If the cancellation is made inside the 12-hour window prior to class, it will be considered a late cancel, the credit will be forfeited, and You will be charged a $15 late cancel fee. If You do not show up to a scheduled class, it will be considered a no-show and You will forfeit the credit and be charged a $25 fee.

Each client is granted one grace period lifeline per membership year. This lifeline may be applied to one late cancel or no-show at the client’s request and is subject to Vibe’s discretion.

Cancellations via text message, Facebook Messenger, Instagram, or other social media platforms are not valid forms of cancellation. You will be charged if the booked session or class is not properly cancelled outside the cancellation window.

3.2 Late Arrivals

You are expected to arrive to any scheduled service on time and ready to begin. There is a 5-minute grace period for late arrivals, so long as You call the studio at 715-832-5050 to let us know You are on your way. Arrivals after 5 minutes will not be admitted and your spot may be given to a client waiting on standby. If there is a client waiting on standby and You do not contact the studio, your spot will be released at the start of class time. In the event You are not admitted into class for the above reasons, it will be considered a no-show and the class credit will be forfeited.

3.3 Waitlist

In the event a scheduled class is booked to capacity, You may place yourself on the waitlist for that class. If You add yourself to a waitlist, You are solely responsible for managing your bookings and cancellations as applicable. Members will automatically be pulled from the waitlist into class up to 30 minutes prior to class start time. If You are pulled off the waitlist and into class during the late cancel window and need to cancel, You are subject to the late cancellation policy.

IV. Studio Policies

4.1 Schedule Changes

Instructors are subject to change and classes are subject to cancellation without notice. When possible, an email will be sent communicating any changes to the schedule. Subject to any opt-out, You consent to receive notice from Vibe pertaining to any class or session You are registered for. Vibe is not responsible if You do not read the notices or if You unsubscribe and do not receive notifications.

4.2 Studio Guests & Childcare

Unattended children and pets are not permitted in the studio. There is no childcare available in the building.

4.3 Minimum Age

Clients must be at least 18 years of age to participate in Vibe services. Clients who are 16 or 17 years of age may participate only with the written consent of a parent or legal guardian, who must also sign the Vibe Client Liability Waiver & Photo Release on the client’s behalf.

4.4 Class Size

Class sizes are limited to ensure the highest quality experience for every client.

4.5 Cleaning

All clients are responsible for wiping down their reformer after class.

4.6 Workout Attire & Grip Socks

All clients are asked to wear appropriate workout attire to class. No jeans or attire with metal accessories or large zippers are permitted on the equipment. For your safety and to protect the integrity of our equipment, clients are recommended to wear grip socks during class, but are not required. We will have socks available for purchase in the studio. Bare feet or grip socks only — no regular socks allowed. No loose clothing or jewelry.

4.7 Retail Sales & Gift Cards

All retail purchases are final sale, except as required by law, including Section 2.5. Gift card sales are also final. Gift cards do not expire. Vibe is not responsible for lost or stolen gift cards and will not replace them.

4.8 Code of Conduct

Vibe is committed to providing a space that is safe, welcoming, and free from disrespectful or offensive behavior for all individuals. Harassment, inappropriate or discriminatory behavior, and continued disruptive or incendiary behavior — as determined in the sole discretion of Vibe — will not be tolerated. Vibe reserves the right to judge behavior and respond accordingly, up to and including termination of a client relationship without refund, except as required by law, including Section 2.5.

4.9 Content Release

Vibe may photograph or film classes, workshops, and events. Whether Vibe may use your name, image, likeness, or voice in its marketing, promotional, and educational materials is governed by the Photo, Video, and Media Release in the Vibe Client Liability Waiver & Photo Release, including your choice to agree or not agree to that release and your right to withdraw consent for future use.

4.10 Security Cameras

Vibe uses video surveillance cameras within the studio for the safety and wellbeing of all members, guests, and instructors. In compliance with state laws, cameras are located in common areas where there is no reasonable expectation of privacy and record video only; they do not record audio. While the cameras’ primary purpose is to provide an added level of security, ownership may from time to time observe studio happenings via the camera stream.

V. Liability Waiver & Limitation of Liability

5.1 Liability Waiver

Participation in any Vibe class, private session, workshop, training, or event requires signing the Vibe Client Liability Waiver & Photo Release.

5.2 Limitation of Liability

The information, software, products, and services included in or available through the Sites may include inaccuracies. Changes are periodically added to the information herein. Vibe may make improvements and/or changes to the Sites at any time. Accordingly, Vibe makes no representations about the suitability, reliability, availability, timeliness, or accuracy of the information, software, products, services, and related graphics contained on the Sites for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided “as is” without warranty or condition of any kind. Vibe disclaims all warranties and conditions, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. To the maximum extent permitted by applicable law, Vibe is not liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use or performance of the Sites or services. If You are dissatisfied with any portion of the Sites or with any of these terms, your sole and exclusive remedy is to immediately cease use of the Sites.

5.3 Prenatal, Pregnant & Postpartum Disclaimer

You acknowledge and agree that participation in any exercise program while pregnant or immediately following a pregnancy may increase the risk of injury to yourself and, if applicable, your unborn child. You confirm that You have consulted with your doctor, midwife, or other healthcare provider regarding your participation in an exercise program and that they have given You permission to participate. You understand and agree that the intensity of your participation must be determined by You in consultation with your healthcare provider. Even during any workout tailored to pregnancy or postpartum, Vibe is not responsible for the intensity or scale of your participation. You agree to discontinue exercise immediately should your medical condition change — including pain, bleeding, discharge, or cramps — and speak with your healthcare provider before resuming. In participating in any Vibe service while pregnant or immediately following a pregnancy, whether knowing or not, You assume all associated risks and release Vibe per the terms of the Vibe Client Liability Waiver & Photo Release.

6.5 Password Protection & No Sharing of Account Information

To access certain features of the Sites You will need a username and password. You agree to keep this information confidential and not share it with anyone else. If Vibe has reasonable grounds to suspect that You have shared your username and password, used the materials and services in a way contrary to what is intended, or shared copyrighted materials with non-purchasing users — Vibe will automatically terminate your account and refuse all current or future use of the Sites without refund, except as required by law, including Section 2.5.

6.8.1 Copyright Consent: Vibe retains all ownership and intellectual property rights to the Services content and materials provided to You through the Sites and otherwise, including all copyrights and trademarks belonging to Vibe and related entities. 6.8.2 Trademarks, Names & Logos: All trademarks, names, and logos used on the Sites or delivered via the Services are either owned by Vibe Pilates or a use right has been granted to Vibe. Your use of the Services and Sites does not allow You to infringe those rights. Without the prior written permission of Vibe, You agree not to display or use in any manner any of the trademarks, names, or logos featured on the Sites for which You do not have personal rights.

This Agreement is governed by the laws of the State of Wisconsin. Any dispute arising under or relating to this Agreement will be brought in the state courts located in Eau Claire County, Wisconsin, including small claims court where the claim qualifies.
