Version 1: General Client Waiver + Photo Release
PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING, YOU GIVE UP THE RIGHT TO SUE FOR INJURIES CAUSED BY ORDINARY NEGLIGENCE.
This agreement is between me, the undersigned client, and Teletek, LLC d/b/a Vibe Pilates, located at 2839 Mall Drive, Eau Claire, Wisconsin (“Vibe”). In this agreement, “Vibe” includes its owners, managers, instructors, employees, and independent contractors.
It applies to every class, private session, workshop, training, and event I attend at Vibe, in The Social 14, The Suite 6, or any other Vibe space.
1. Acknowledgment of Risk
I understand that reformer Pilates is physical exercise performed on equipment with a moving carriage, springs under tension, straps, ropes, pulleys, a footbar, and raised platforms. Participation involves inherent risks of injury, illness, and other health concerns that cannot be eliminated even when care is taken.
These risks include, but are not limited to:
Muscle strains, sprains, tears, and joint, back, neck, or spinal injuries
Falls while getting on or off the reformer, or while standing, kneeling, or balancing on a moving carriage
Pinched, crushed, or caught fingers, hands, feet, hair, clothing, or jewelry in the carriage, springs, or other moving parts
Injury from springs, straps, or ropes that release, slip, or recoil, or from an incorrect spring setting
Equipment malfunction or failure, or my own or another participant’s misuse of equipment
Slipping on the carriage, platform, or studio floor
Dizziness, fainting, dehydration, overexertion, and aggravation of a pre-existing condition
Cardiac events, stroke, and in rare cases serious injury, permanent disability, or death
Contact with other participants or their equipment
Exposure to communicable illness in a shared indoor space
Injury related to hands-on adjustments or physical cues from an instructor
I understand these risks, I have had the chance to ask questions about them, and I voluntarily choose to participate.

2. Health and Physical Condition
I confirm that I am physically able to participate and that it is my responsibility to consult a physician before starting. I also agree that:
I will tell my instructor before class about any injury, surgery, medical condition, or physical limitation that could affect my participation.
If I am pregnant or recently postpartum, I have my healthcare provider’s approval to participate and will tell my instructor before each class.
I am responsible for monitoring my own limits. I will modify or stop any exercise that causes pain, dizziness, shortness of breath, or discomfort, and I will tell my instructor right away.
Vibe instructors are not medical professionals. Nothing they say is medical advice, a diagnosis, or treatment.
I will not participate while under the influence of alcohol, drugs, or any medication that impairs my balance, coordination, or judgment.
3. Studio Rules and Equipment Safety
I agree to follow all posted rules and instructor directions, including:
Arriving on time; Vibe may refuse late entry for safety reasons, especially for first-time clients who have not had an equipment orientation
Using the reformer and all other equipment only as instructed, and changing springs or settings only as my instructor directs
Securing long hair and removing or securing loose clothing and jewelry that could catch in moving parts
Checking my equipment before use and reporting any damage or concern to my instructor before continuing
Wiping down my reformer after class
I consent to hands-on adjustments from instructors. I can decline them at any time by telling my instructor.
Vibe may remove me from a class, or decline my participation, if it reasonably believes my participation is unsafe for me or others.
4. Assumption of Risk and Release of Liability
I voluntarily assume all risks described in Section 1 and all other risks of participating in any class, training, or service offered by Vibe, including my use of its facilities and equipment.
To the fullest extent permitted by Wisconsin law, I release, waive, and discharge Vibe from any and all claims, damages, or liabilities for personal injury, illness, death, or property damage arising from my participation, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF VIBE.
This release is binding on me and on my spouse, heirs, personal representatives, and assigns.
This release does not apply to injuries caused by Vibe’s reckless or intentional conduct, or to any claim that cannot be waived under Wisconsin law.
I understand that signing this release is a condition of participating at Vibe. I have had the opportunity to read it, to ask questions, and to discuss any of its terms with Vibe management before signing.

5. Medical Emergency
In the event of an accident or medical emergency, I authorize Vibe’s staff to call emergency services and to secure medical treatment as they deem necessary, including first aid, CPR, and use of an automated external defibrillator (AED). I agree to be financially responsible for any resulting costs, including ambulance transport and treatment.

6. Photo, Video, and Media Release
I grant Vibe, its representatives, and assigns the right to photograph, record, and use my name, image, likeness, and voice for marketing, promotional, and educational purposes, in perpetuity and without compensation. This is my written consent to that use under Wisconsin law.
I understand these materials may appear in print and digital formats, including the Vibe website and app, social media, email, and advertising. I waive any right to inspect or approve the finished materials.
I may withdraw this consent for future use at any time by written notice to Vibe. Withdrawal does not apply to materials already published or printed.

7. Personal Property
I acknowledge that Vibe is not responsible for loss, theft, or damage to personal property while on the premises or in the parking area, including items left in cubbies or lockers.
8. General Terms
Governing law and venue. This agreement is governed by the laws of the State of Wisconsin. Any dispute will be brought in the state courts located in Eau Claire County, Wisconsin.
Severability. If any part of this agreement is found unenforceable, the rest remains in effect, and the unenforceable part will be enforced to the fullest extent Wisconsin law allows.
Entire agreement. This is the entire agreement between me and Vibe on these subjects. Membership, pricing, and cancellation terms are covered separately.
Electronic signature. I agree that my electronic signature, including one given through Vibe’s website, app, or booking system, has the same effect as a handwritten signature.
Minors. Participants under 18 must have a parent or legal guardian sign below. The parent or guardian agrees to these terms on the minor’s behalf and on their own behalf.
9. Agreement
I have read this waiver and fully understand its terms. I understand that I am giving up legal rights, including the right to sue Vibe for ordinary negligence. I voluntarily agree to the conditions stated above and acknowledge that this release will remain in effect for all future participation unless revoked in writing. A written revocation applies only to participation after Vibe receives it.
